California Public Records Act Requests

The Fullerton Joint Union High School District is committed to transparency and providing the public with access to District records in accordance with the California Public Records Act (CPRA).

The CPRA provides the public the right to inspect or obtain copies of public records maintained by state and local government agencies, unless the records are exempt from disclosure under state or federal law.

This webpage provides a convenient way for community members to access records that have previously been made publicly available.

Definition of a Public Record

The California Public Records Act generally defines a public record as a writing containing information related to the conduct of the public's business that is prepared, owned, used, or retained by a state or local agency, regardless of its physical form.

Public records may include documents, emails, reports, correspondence, photographs, electronic files, and other information maintained by the District that relates to District business.

Student education records and personally identifiable student information are generally protected from public disclosure by the Family Educational Rights and Privacy Act (FERPA) and other applicable state and federal laws.

The CPRA does not require the District to create a new record that does not already exist. If responding to a request requires data compilation, extraction, computer programming, or the creation of a computer report to produce information from electronic records, the requester may be responsible for the associated costs as permitted by law.

If a request may result in a charge, the District will notify the requester before the work is completed.

Records Exempt from Disclosure

The California Public Records Act and other state and federal laws provide exemptions that allow or require certain records or information to be withheld from public disclosure.

Examples may include:

  • Certain personnel, medical, or similar records when disclosure would constitute an unwarranted invasion of personal privacy
  • Student education records and personally identifiable student information
  • Certain investigative or security related records
  • Preliminary drafts, notes, or memoranda that meet the requirements for exemption
  • Attorney client privileged communications and other legally privileged records
  • Information protected from disclosure by other state or federal laws

When a record contains both public and confidential information, the District will generally redact the confidential or exempt information and provide the remaining portions of the record when required by law.

California Public Records Act Process

To help the District locate and respond to records requests efficiently, requesters should provide as much detail as possible about the records being requested. Helpful information may include the type of record, subject matter, relevant school or department, names associated with the record, and an approximate date range.

After receiving a request, the District will:

  1. Review the request to determine what records are being requested and which District departments or schools may maintain them.
  2. Respond within the time required by law. The District will generally determine within 10 days whether the request seeks disclosable public records in the District's possession. In certain unusual circumstances, this determination period may be extended as permitted by law.
  3. Search for and review responsive records. Records will be reviewed to determine whether any information is confidential or exempt from disclosure.
  4. Provide responsive records. Disclosable records will be provided within a reasonable period of time based on the scope and complexity of the request.
  5. Communicate any applicable costs. If duplication, data extraction, or programming costs are permitted under the CPRA, the requester will be notified before those costs are incurred.

Requests that clearly identify the records being sought can generally be processed more efficiently.

Sexual misconduct should include boundary crossing violations, sexual harassment, sexual assault by teachers, guidance counselors, or principals against students, with all student names or identifying information redacted.     Such public records should include:    Written allegations or claims made to the district   Investigatory reports   Determinations; decisions; orders; resignation letters; employment reclassification documents  Settlement or separation agreements   Termination and/or transfer papers  Letters of reproval and/or other disciplinary actions  Referrals to law enforcement   Reports to the the California Commission on Teacher Credentialing    Courts have noted that misconduct complaints against ordinary employees other than peace officers are disclosable:“where the charges are found true, or discipline is imposed, the strong public policy against disclosure” of private matters “vanishes; this is true even where the sanction is a private reproval. In such cases a member of the public is entitled to information about the complaint, the discipline, and the information upon which it was based.” American Federation of State Etc. Employees v. Regents of University of California, 80 Cal. App. 3d 913, 918 (1978) (cleaned up).  Additionally, where charges are not found true but “complaints of a public employee’s wrongdoing and resulting disciplinary investigation reveal allegations of a substantial nature, as distinct from baseless or trivial, and there is reasonable cause to believe the complaint is well founded, public employee privacy must give way to the public’s right to know." Bakersfield City School Dist. v. Superior Court, 118 Cal. App. 4th 1041, 1045 (2004). The complete, final laboratory reports, all pages, for every PFAS and fluorine test of the proposed artificial turf or any of its components, including but not limited to Test Number 0304701 (BS EN 14582 total fluorine) and Test Number 0321135 (EPA Method 1633). For each report, please include the sample identification, the sample description and construction, the method detection limits and reporting limits, and any data qualifiers.  2. Records reconciling the product identified in those reports, including any records explaining why the EPA Method 1633 report (Test Number 0321135) identifies the sample as “TenCate PIVOT” on its first page and as “Allsport Ultra” on its second and third pages, and records identifying which artificial turf carpet product will be installed at each school.  3. Records sufficient to show, component by component, which elements of the complete artificial turf system were tested for PFAS and which were not, separately identifying (a) the carpet, including fibers, backing, and coatings; (b) the adhesives used in manufacturing the carpet; (c) the seam adhesive applied on site during installation; (d) the shock pad or shock-absorbing layer; and (e) the nailer boards.  4. Records identifying the material composition of the nailer boards, including whether they contain plastic recycled from artificial turf or other recycled material, and the source of that material.  5. For each laboratory report identified above, the laboratory’s accreditation or certification scope for the methods used (such as ELAP or ISO/IEC 17025 accreditation), the chain-of-custody documentation, the raw analytical data, and the complete quality assurance and quality control package, including calibration records, method blanks, matrix spikes, and surrogate or isotope-dilution recoveries.  6. Product submittals, specifications, and data sheets for the proposed artificial turf system and its components.  7. Correspondence between the District, or its environmental consultant, and the manufacturer or the testing laboratory concerning what was tested and the scope of that testing.  8. Any analysis or testing of the leaching or release of PFAS from the artificial turf system, including any synthetic precipitation leaching procedure testing or any testing of weathered material, and any analysis of PFAS migration into stormwater, soil, surface water, or groundwater.  If any category above has no responsive records, I ask that the District state that in writing.   Government Code section 7922.535 requires the District to determine within 10 days whether the request seeks disclosable records and to notify me of that determination. If the District withholds any record, please identify it and cite the specific exemption relied upon, as required by Government Code section 7922.000. I request the records in electronic format under Government Code section 7922.570.
